CRYPTO CLARITY ACT OR MARKET STRUCTURE BILL

The CLARITY ACT was passed by the US House of Representatives in July 2025. This bills aim is to create comprehensive regulatory framework for digital assets.

The bill is facing a complex path through the Senate..... however many of the Senate members are saying that the bill will go through and be ready to be signed by President Trump no later than before Thanksgiving!

KEY ASPECTS OF THE CLARITY ACT

Regulatory clarity so that all crypto investors will know the rules and the industry will move away from "Regulation by Enforcement". What is regulation by enforcement? Regulation by enforcement is basically when government acencies make the rules by adjudications and law suits against citizens and legal entities rather than relying on already established rules and regulations made by lawmakers.

Agency Jurisdiction

CFTC Authority: The CFTC (Commodities Futures Trading Commision) will have authority over all Cryptocurrencies considered to be commodities.

SEC Authority: The SEC (Securites Exchange Commision) will have jurisdiction over all digital assets considered securites.

Why is the Clarity Act so important?

For the most part, at this moment, only retail investors are involved in the overall crypto market. Who are RETAIL INVESTORS? Normal, average people who work a nine-to-five and are the bottom 90% of the United States...

Individuals who allocate funds into stocks, bonds, IPOs, retirement accounts, and similar instruments with the aim of achieving financial gains in the future.

Once clear rules and regulations are made and implemented into the digital asset market INSTITUTIONAL INVESTORS will come into the market....
